Bei der medizinischen Behandlung des Patienten im Krankenhaus kommen in einem Schadensfall regelmäßig mehrere Haftungsgegner in Betracht: selbstliquidierende Chefärzte, angestellte Krankenhausärzte, Belegärzte oder der Krankenhausträger selbst. Gerade auch das U.S.-amerikanische Recht kennt ähnliche Probleme. Dieser Rechtsunsicherheit versucht das Konzept der «medical enterprise liability» entgegen zu wirken, indem es grundsätzlich die Haftung für sowohl von angestellten Ärzten als auch von «independent contractors» fahrlässig verursachte Schäden auf den Krankenhausträger überträgt und gleichzeitig den behandelnden Arzt von der Haftung freistellt. Es wird untersucht, ob die «medical enterprise liability» etwa für das deutsche Recht zweckmäßig und mit dem deutschen Recht vereinbar ist.
